On May 8, 2009, SL Liquidating, Inc. (formerly SENCORP) and nearly all of its operating affiliates (the "Debtors") filed voluntary petitions for relief under Chapter 11 of the United States Bankruptcy Code. The operating affiliates are: SP Liquidating, Inc. (f/k/a Senco Products, Inc.); SE Liquidating, Inc. (f/k/a Senco Export, Inc.); GS Liquidating, LLC (f/k/a SenSource Global Sourcing, LLC); TR Liquidating, LLC (f/k/a TyRex, LLC); GF Liquidating, LLC (f/k/a Global Fastening Solutions, LLC); AF Liquidating, LLC (f/k/a Agrifast, LLC); NC Liquidating, LLC (f/k/a Nexicor, LLC); OF Liquidating, LLC (f/k/a Omnifast, LLC); SC Liquidating, Inc. (f/k/a S C FINANCIAL, INC.); SI Liquidating, Inc. (f/k/a Senco International, Inc.); SM Liquidating, Inc. (f/k/a Sentron Medical, Inc.); and GL Liquidating, Inc. (f/k/a Gregg Laboratories, Inc.).
On July 2, 2009, an order was entered approving the sale of substantially all of the Debtors' assets to an investor group led by Wynnchurch Capital, Ltd., and including Great Lakes Equity Partners. SL Liquidating's Bankruptcy Case
SL Liquidating's bankruptcy case is pending in the United States Bankruptcy Court for the Southern District of Ohio, Western Division (the "Bankruptcy Court"). It has been assigned to the Honorable J. Vincent Aug, Jr. The location of the Bankruptcy Court may be found by clicking on the "Contact Information" tab at the left.
Joint Plan of Liquidation and Disclosure Statement; Disclosure Statement Hearing
On October 15, 2009, the Debtors filed with the Bankruptcy Court a Joint Plan of Liquidation and a Disclosure Statement (both of which, together with certain related documents, can be viewed by clicking here). The Bankruptcy Court has scheduled a hearing on February 17, 2010 at 10:00 a.m. (Prevailing Eastern Time) to consider the adequacy of the proposed Disclosure Statement.
Proofs of Claim
On July 2, 2009, the Bankruptcy Court entered an order (the "Bar Date Order") establishing (i) August 11, 2009, at 4:00 p.m. (prevailing Eastern Time) as the last date and time for each person or entity to file a proof of claim based on claims that arose prior to May 8, 2009, the date on which the Debtors commenced their Chapter 11 cases and (ii) November 4, 2009, at 4:00 p.m. (prevailing Eastern Time) as the last date and time for governmental units to file proofs of claim against the Debtors.
